  1. The Company
    "The Company" or "We" or "Us" means Safiria Kenya Inv. Co. incorporated in the Republic of Kenya in 2005.

  2. General Information
    The terms and conditions herein are subject to amendment from time to time and apply to all our services made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "Safiria Online Reservations System") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below.

    These pages and infrastructure of these pages, and the service provided on these pages and through the website (the "service") are owned, operated and provided by The Company and are provided for your use, subject to the terms and conditions set out below.

    You are not allowed to re-sell, deep-link, use, copy, monitor, display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

  3. Scope of Services Rendered
    Through the website we provide an online platform through which hotels, lodges, resorts, park campsites and other types of accommodation (collectively referred to as "hotel" or "hotels") can advertise their rooms for reservation, and through which visitors to the website of the hotel or our website can make such reservations. By making a reservation on the Safiria Online Reservations System, you enter into a direct (legally binding) contractual relationship with the hotel at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the hotel, transmitting the details of your reservation to the relevant hotel and sending you a confirmation email for and on behalf of the hotel.

    When rendering our services, the information that we disclose is based on the information provided to us by the hotels. As such, the hotels are fully responsible for availing to us updated room rates, room availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each hotel remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the room rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of (the quality, service level or rating of) any hotel made available.

  4. Pricing
    All pricing is in United States Dollars and is clearly identified by a currency prefix, for example, US$ or USD. Reservations made through the Safiria Online Reservations System do not attract any booking fees.  All prices include applicable taxes and levies at the current prevailing rate.  Prices are subject to change without notice. However, your price is guaranteed once you are given a reservation number.

    Costs not included in prices shown include airfares, visa and passport costs, travel insurance, vaccination and medical expenses, excess baggage, airport departure taxes, laundry, postage, phone calls, fax/email charges, beverages, items of a personal nature, tips and meals (with the exception of meals associated with the specific reservation e.g. breakfast, half board or full board).  

  5. Reservations and Payments
    In cases where a group reservation is being made, the person making the reservation ("the party leader") must be at least 18 years of age and must be authorized to make the reservation on the basis of these Terms and Conditions by all persons named on the reservation. By making a reservation, the party leader confirms that he/she is so authorized and that all party members agree to be bound by these Terms and Conditions. The party leader is responsible for making all payments due to the hotel(s) where reservations have been made.

    The use of our online hotel reservations service is free of charge. Therefore, we will not charge a booking fee or add any additional fees to the room rates specified by the respective hotels. A 50% deposit is required to confirm your booking and can be paid via Paypal, credit card or bank transfer.  The balance of the payment must be paid at least 45 days prior to your arrival. If you choose to pay your deposit for a reservation using Paypal or secured credit card payment options, the deposit will be deducted from your Paypal account or credit card immediately and your confirmation firmed up instantaneously.  If you choose to pay via bank transfer, you will receive a reservation confirmation but your payment must reach our account within 5 working days otherwise your reservation may be cancelled. Please note that if your arrival date is 30 days or less from date booked, deposit required is 100% of total amount.

  6. Amendments and Cancellations
    7. The Safiria Online Reservation System includes a provision for making amendments and cancellation. In any event of an amendment or cancellation, you and the respective hotel are notified by email immediately. Amendments do not attract a penalty. In case of cancellation of a confirmed reservation, the charges will be applied as follows
      • Cancellation 45 days or more prior to arrival date - Amount paid will be refunded less 5% of the amount to cover bank charges.
      • Cancellation 44-30 days prior to arrival date - 25% of total amount charged as cancellation fee.
      • Cancellation 29-15 days prior to arrival date - 75% of total amount charged as cancellation fee.
      • Cancellation 7-14 days prior to arrival date - 50% of total amount charged as cancellation fee.
      • Cancellation less than 7 days prior to arrival date - NO REFUND - 100% of total amount charged as cancellation fee.
      • No show - NO REFUND - 100% of total amount charged as no-show fee.

  1. Privacy Policy
    We are committed to protecting the privacy and security of online visitors to our website. You can visit our website without telling us who you are or giving us any personally identifiable information. The only information that is stored on our servers is the backup copy of your reservation based on the information which you submit through the booking form. Our servers do not collect or keep any credit card records.

    With the exception of disclosures required by law in any relevant jurisdiction and the disclosure of your name, email address and any other details provided for completing your booking with the relevant hotel of your choice, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our Company employees and our trusted agents and representatives who have access to this information with our permission and who need to know or have access to this information to perform our service to and for the benefit of you.

  2. Your Responsibility
    You should familiarize yourself with any health or visa requirements that may be applicable in the countries and areas that you intend visiting, and you shall be responsible for all entry, exit, health and other documents required by law, regulations, orders, demands or requirements of the countries visited or transited. You shall carry a valid passport at all times. It is your responsibility to advise the hotel of any special requirements you may have while making your booking. The making of a booking constitutes your acceptance of all booking terms and conditions as described herein.

  3. Disclaimer
    Subject to the limitations set out in these terms and conditions, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the hotel as made available on our website, (iii) the services rendered or the products offered by the hotel, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the hotel (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

  4. Jurisdiction
    These terms and conditions shall be governed and construed in accordance with the Laws of the Republic of Kenya without giving effect to principles of conflict of laws. You agree to submit to jurisdiction in Kenya and further agree that any cause of action arising under this Agreement may be brought in a court in the Republic of Kenya.
